As a Landlord do you need an EICR or Gas Safety Certificate?

Yes, if you’re a private landlord, you are responsible for your properties, and you have a duty of care to your tenants.

Electrical Safety – The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 made Electrical Installation Condition Report (EICR) checks compulsory for all tenancies from 1 April 2021.

Electrical installations include all the fixed electrical equipment supplied through the electricity meter. These installations deteriorate over time, and an EICR is a document produced by a qualified person following an assessment of those installations. The landlord must obtain the EICR from the person conducting the inspection and test, which will explain the outcomes of the test, and mention any investigative or remedial work required as a result. The landlord must then supply a copy of this report to the tenant within 28 days of the inspection and test, to a new tenant before occupation of the premises, and to any prospective tenant within 28 days of receiving a request for the report.

Gas Safety – The Gas Safety (Installation and Use) Regulations 1998 state that landlords must make sure all gas appliances, fittings, chimneys, and flues are safe and working efficiently.

If your rental property has gas appliances, you have a legal responsibility to ensure your gas appliances and flues undergo an annual gas safety check. After the check you’ll receive a Landlords Gas Safety Certificate listing the checks that were carried out. Following this you must provide your tenant with a copy of the certificate within 28 days of the check, or before the start of the tenancy for a new tenant. It’s also your responsibility to ensure all gas pipework, appliances, chimneys, and flues are kept in a safe condition.
